Entire Agreement

These Terms and Conditions, in connection with the other obligations and rules detailed in writing on the Site, constitute the entire agreement between you and the Site and cannot be modified by you. These Terms and Conditions cannot be modified on an individual basis by any person affiliated, or claiming affiliation, with the Site. Nothing in this subsection will prevent the Site from modifying the terms of these Terms and Conditions and posting such modifications on the Site However, TriviaTank strives at creating a trivia community and would like to get your feedback on our games and service.

Severability

If any portion of these Terms and Conditions is deemed void or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not influence the validity and enforceability of the remaining provisions.

Term

The license for TriviaTank.com shall be effective from the date you begin using TriviaTank.com until the date of termination. This license shall terminate automatically when any of the following occur: (i) TriviaTank.com removes the site, or (ii) you fail to obey the restrictions described herein. Further, TriviaTank may terminate this license at any time by providing individual or public notice of the intent to terminate.

Eligibility

TriviaTank requires users of the TriviaTank website and any of its free services to be 18 years or older. TriviaTank does not consider the website or any of the free services to be for individuals under 18 years of age. By using this website you confirm that you are 18 years of age or older. If you are under 18 years of age please do not access the TriviaTank.com website.
You agree that if your computer/web device and or internet connection accesses our website that you will not allow children under 18 years old to access our website and that if you do allow children under 18 years old to access the TriviaTank.com website or its free services with your computer/web device and or internet connection that you will assume full liability for any consequences and that NEITHER TriviaTank.com or ANY THIRD PARTY CONTENT PROVIDER NOR THEIR RESPECTIVE AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE BY USERS UNDER 18 YEARS OF AGE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
By establishing an account and/or participating in any TriviaTank game or tournament you are admitting that the entirety of TriviaTank content is the protected property of TriviaTank and its licensors. You recognize that you are provided access to this information for your own individual use and you agree not to change, sell, publish, participate in the transfer or sale of, create derivative works or in any other way exploit this information for any purposes. The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site, including the names of all games and puzzles, are registered and unregistered Trademarks of the Site and/or others. Nothing contained on the Site should be construed as granting, by implication, estoppels or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of the Site or such third party that owns the Trademark displayed on the Site. Your misuse of any Trademark displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited.
